Kuwait NFP is pleased to
announce that the contract for providing legal services to Kuwait NPF has been
awarded to Al-Essa & Partners along with their international affiliates
Hogan and Hartson LLP.
Kuwait NFP
informs all of the legal entities that have previously bid for the original
Tender No. 2/2006-2007 (Revised) announced in the official gazette Kuwait El-Youm
on 24 December 2006 that, due to procedural reasons, this tender has to be
re-issued.
Kuwait NFP
seeks proposals
(hereinafter referred to as the "Tender Offers") from Kuwaiti registered law
firms with strong international affiliation to provide a range of legal
consulting services to Kuwait NFP within the Follow-Up Programme of the United
Nations Compensation Commission (UNCC) for the Environmental Remediation Claims,
pursuant to United Nations Governing Council Decision 258 of 2005 as outlined in
the Specific Terms of Reference included at Section 3 of the Tender.
International
law firms interested in submitting a Tender Offer will only be eligible if they
are represented by local authorized firms as stated above. The Contract will
be concluded between the local legal firm and Kuwait NFP.
The Tender
can be obtained from the Finance Division, Purchasing Department Procurement
Section of PAAC at Shamiya Area, 3rd Block, Al-Shamiya Secondary
School for Boys, Shamiya District during the official working hours i.e. 7:30 AM
to 2:00 PM (14:00) from 6th May 2007 upon the payment of the Tender Fees
of KD. 150.
The Tender
Documents may also be obtained from the Kuwait NFP website after entering the
firm’s email and website address. In such case, tender submission will not be
accepted unless an original tender purchase receipt is presented
with the Tender Offer. Failure to present the tender purchase receipt
will result in refusal by Kuwait NFP authorities to receive the Tender Offer.
The Tender Offer to
the RFP must be prepared in English in accordance with the terms and conditions
stated in Section 1: General Terms and Conditions (Arabic) also translated into
English in Section 2: General Terms and Conditions (English). Following the
selection of the successful Tender Offer, the contract for legal consultancy
services (the "Contract") will be signed in both English and Arabic. All
clarifications and/or disputes will be settled with reference to the Arabic
version of the Contract.
The Specific Terms of
Reference (ToR) are presented in Section 3 of this RFP.

An
announcement of the Tender and Tender details will also be announced in the
Official Gazette (Kuwait El-Youm) on 6th May 2007.
The Tender Offer must be divided into Technical and Financial
proposals which each proposal inserted in separate envelopes, and to include
details as follows:
1.
Technical Proposal (separate envelope)
a)
Must include a cover letter addressing the following points:

Name and title of the
firm and its official registration;
·
The name and title of
the international firm associated with the local firm and nature and type of
association with proof that local legal firm is the official representative of
the international firm, legally acknowledged or notarized by an authorized
notary in the international firm's country of business or incorporation;
·
Confirmation that the
submitted Tender Offer is in accordance with the conditions stated in this RFP;
and
·
Confirmation that the
Preliminary Insurance of 5% of the total annual Tender Offer value valid for 90
days is included in the Financial Proposal.
b)
2 original hard copies of the technical proposal.
c)
Compact Disk (CD) in Read Only Format containing the Technical Proposal
submission along with the attachments. The Technical Proposal must be in
Microsoft Word Format, the attachments could be in PDF format.
2. Financial Proposal (separate envelope)
a)
Preliminary Insurance of 5% of the total annual Tender Offer value valid for 90
days;
b)
1 original hard copy of the Financial Proposal. The Tenderer must include a
break down of the total Tender Offer value noting that all financial details are
to be presented in Kuwaiti Dinars;
c)
Tenderer must fill out, sign and stamp the Arabic Declaration Form in Article 27
of Section 1 and the corresponding English Declaration Form in Article 27 of
Section 2; and
d)
Compact Disk (CD) in Read Only Format containing the Financial Proposal
submission along with the attachments. The Financial Proposal could be in
Microsoft Word or EXCEL Format.
Tender Offers are to be dropped in the tender box located in the
Headquarters of Kuwait NFP's Secretariat, PAAC, at the address given below no
later than 2:00 pm Kuwait Local Time on Sunday 20th May 2007. Kuwait
NFP will give no consideration to Tender Offers submitted beyond this time and
date, and/or revisions of the Technical Proposal or price modifications to the
Financial Proposal after submission of the Tender Offer.
The Tender Offer shall be
clearly typed in English. No striking out, erasure or interlineations in the
text is allowed. Your attention is particularly drawn to Article 22 of the Law
on Public Tenders with respect to the completion of the Tender Offer, and there
shall be no alterations or erasures on the Tender Offer without being explained
in writing and initialed.
A partial or incomplete Tender
Offer shall not be considered. The Tender Offer shall be the responsibility of
the Tenderer, and no relief or consideration shall be given for errors or
omissions in the tendered price or proposals.
The Tenderer must submit the
Technical Proposal of the Tender Offer in a separate envelope than the Financial
Proposal according to details above. All envelopes are to be sealed with red
wax without stating the name of the Tenderer or any sign that
might lead to the disclosure of the Tenderer identity. The envelopes along with
the Tender number and date should be addressed to:
