KUWAIT ENVIRONMENTAL MONITORING AND ASSESSMENT STUDIES - KMAS

In 1994 PAAC submitted to the United Nations Compensation Commission (UNCC)
five claims representing environmental damages to Kuwait’s Groundwater,
Terrestrial, Marine & Coastal, Oil lakes and Public Health sectors (the “Environmental Claims”).
Prior to review of the Environmental Claims it was agreed by the State of Kuwait and UNCC
that the original claims would be split into three categories
(Installment 1 - Monitoring and Assessment Claims, Installment 2 – Invoice Claims,
and Installments 3, 4 part 1, 4 part 2, and 5 – Remediation Claims) and reviewed accordingly.
Splitting of the original claims was necessary so that the results of the assessment studies
performed in the monitoring and assessment phase could be used to select and decide on the
remediation technologies and the recommendation of awards to carry out the remediation/rehabilitation
of the damaged environment.

The portions of claims identified as "Monitoring and Assessment Claims" were reviewed and recommended
under UNCC Governing Council (GC) Decision 132 The portions of claims identified as
"Invoices Already Paid" were recommended under UNCC GC Decision 171 and the portions of claims
identified as "Future Remediation Claims" were recommended under UNCC GC Decisions 212, 234, 235 and 248.
The Monitoring and Assessment Claims were fully paid and the funds are being utilized to study the long term effects
