KUWAIT NFP

The Council of Ministers by its Decree 564 of 24 June 2006 established a Central Committee to supervise the implementation of projects related to environmental rehabilitation and appointed it as the State of Kuwait's National Focal Point (Kuwait NFP).
CSC members include:

-The Ministry of Energy (Chairperson) and represented by H.E. the Minister of Energy.
-Public Authority for Assessment of Compensation for Damages Resulting From
 Iraqi Aggression - PAAC (Secretariat)
-Environmental Protection Agency (Member)
-Ministry of Foreign Affairs (Member)
-Ministry of Finance (Member)

In order to initiate the remediation work in compliance with the UNCC guidelines as stipulated in the United Nations Governing Council Decision 258; Kuwait NFP developed an organizational structure for the State of Kuwait’s Environmental Remediation Program (KERP). All of the KERP includes environmental remediation projects defined in annex 1-10, Guidelines of UNCC Governing Counsel decision 258.

The organizational structure is presented below.


 
 

The Organization Structure of Kuwait NFP

The organizational structure of Kuwait NFP is composed of the following sections:-

1. The Board of the Kuwait NFP
The main role of Kuwait NFP is the following:-
 
1. Define the overall objectives, scope and requirements of the Kuwait
    Environmental Remediation  Program (KERP).
    The program will include the following components:
    a) Definition of the scope of the environmental remediation activities
        that will be the subject of KERP.
    b) Elaboration of financial expenditures required to implement the full
        scope of the environmental remediation activities within KERP.
    c) Identification of the expected sources of finances and specification of the
        financial plan for expenditures over the implementation period of each project within KERP.
    d) Setting of priority for implementation of projects within KERP based on
        predefined criteria such as impact of damage on public health, economy,
        operation and availability of financial resources.
2. Define the role of KERP to support regional cooperation activities for the
    remediation of environmental damages and determine the cost to support such activities.
3. Ensure the implementation of the Kuwait environmental remediation projects
    in accordance with the UNCC Guidelines described in Decision 258.
4. Allocate funds for the execution and implementation of environmental
    remediation projects defined under KERP. The funds are managed by the Ministry
    of Finance and originate from compensation payments made by the UNCC for the
    environmental remediation claims stated in UNCC Decision 258.
5. Develop the Terms of Reference (ToR) and select the Project Planning and
    Supervision Contractors (PPSC).
6. Ensure compliance with UNCC guidelines.


2. Project Planning and Supervision Contractor (PPSC)
The role of the PPSC will be to support the NFP in achieving its national, regional and international objectives and fulfilling its duties. The PPSC will convert KERP into executable projects by preparing executable master plans for all the Projects and related activities. More specifically, PPSC will be engaged to plan and supervise the implementation and execution of KERP within the scope, timescale and budget defined by the Kuwait NFP.

3. Organization Engaging Field Contractors (OEFC)
The OEFCs are responsible for the execution of the ERPs defined by Kuwait NFP. The role and responsibility of each OEFC is as follows:

 
1-Facilitate inspection of damaged sites by:
   a. Kuwait NFP;
   b. PPSC;
   c. Field Constractors (FC);
   d. Independent Reviewers; and
   e. UNCC inspectors
       The Inspection will be aimed to support KERP planning, implementation and audit.
2- Issue tender documents based on general ToRs for each project provided by PPSC.
3- Assist PPSC to prepare ToR and conditions for the implementation of each project;
4- Pre-qualify Field Contractors (FC)
5- Select Field Contractors (FC)
6- Prepare and review the plan of execution with the PPSC for each project;
7- Provide all logistical support to Kuwait NFP, PPSC and FC;
8- Carefully delineate contracting zones and prepare them for contractor
    equipment, facilities and operational activities;
9- Ensure total transparency in the execution of all ERPs in terms of progress,
      financial and legal issues through the preparation of detailed project progress
      reports;
10- Prepare for and facilitate UNCC visits whether from the Secretariat, UNCC
      experts or the Independent Reviewers for inspections of ERP implementations;

4. Field Contractor, FC
The FC is the entity responsible for the execution of the Projects. A specific project will be allocated to the field project contractor based on its qualification, experience and performance in the contract bidding process. The contractor will be chosen after review of all the bids according to a review procedure adopted by OEFC.

5. Project Funds, PF
All UNCC payments and other Funds are allocated to a centralized unit called the "project Funds". This Fund is situated within the Ministry of Finance and managed by the Kuwait NFP.
Payment to all elements (The PPSC, the FC and KERP expenditure are paid out of the Project Funds by instruction from the  Kuwait NFP).
